Registered designs are protected under the Designs Act of 2001 for a period of 10 years, with the possibility of extending the protection for an additional 5 years. If a registered design is copied or misused, the owner has the legal right to take action and seek damages.

What is a Design?
In simple terms, design refers to the appearance and feel of an object. It encompasses the shape, pattern, and decoration that make an item visually unique, appealing, and distinct from others. As defined in Section 2(d) of the Designs Act of 2001, a design includes the distinctive features of shape, figure, or blueprints, as well as the arrangement of lines, colors, patterns, or combinations of these elements added to an article. These features can be incorporated using various methods, such as mechanical, manual, chemical, or other processes, either individually or in combination. The design’s value is judged purely on its visual impact on the final product, excluding any mechanical or functional aspects. Designs can be both three-dimensional (like product shapes) and two-dimensional (such as patterns or decorations). Design registration is a legal process that protects your original design by officially registering it with the Indian Patent Office.

Registration Guidelines
Conditions for Design Registration in India
To be eligible for registration under the Design Act of 2000, the design must be new, original, and creative, without copying an existing design. It should not have been disclosed to the public, used, or published anywhere in India or internationally before the application date. The design must focus purely on the visual aspects such as shape, pattern, or ornamentation and should not have any functional or technical elements. It should be visible in the final manufactured form of the article.
The design cannot be offensive, obscene, or contrary to public morality. It must be applied to a tangible product that is capable of being produced through industrial processes. Abstract ideas are not eligible for registration. Furthermore, the design must not conflict with trademarks, logos, or artistic works already protected by copyright or trademark laws.
Exclusions from Design Registration
Not every design is eligible for registration under the Designs Act of 2000. The following categories are specifically excluded from design protection:
Creative Works
Books, calendars, stamps, tokens, artistic paintings, sculptures, and other literary or artistic works are safeguarded under the Copyright Act of 1957 and do not require design registration.
Architectural Structures
Architectural structures such as buildings, bridges, and similar constructions are not eligible for design registration.
Geographical Representations
Maps, charts, and topographical representations are not eligible for design protection.
National Symbols & Emblems
Designs that replicate or are derived from national flags, official symbols, or government insignia are not eligible for registration.
Functional Features
Designs that are solely functional, mechanical, or driven by technical requirements, rather than aesthetic value, are not eligible for registration.
Trademark or Branding Elements
Logos, brand names, and trademarks are already safeguarded under the Trademark Act of 1999 and cannot be registered as designs.
Submission Essentials
Documents Required for Design Registration in India
To register a design in India, applicants must submit several documents to the Controller-General of Patents. The application form (Form-1) requires the applicant’s details, product classification, and information about the article to which the design applies, along with its classification under the Locarno system. Four copies of the design, in the form of drawings, photos, or digital images from different angles, are required as design representations. A brief statement of novelty highlighting the unique aspects of the design must be included.
If filing through an agent, a power of attorney (Form-21) on ₹100 non-judicial stamp paper is necessary. If claiming priority from a foreign application, a certified copy of the original application, along with an authenticated English translation, must be submitted. A declaration of proprietorship confirming the applicant’s ownership of the design is also required. Lastly, proof of fee payment must be attached with the application.

Examination Process
The Indian Design Office will assess the application to ensure it complies with all requirements. If any objections or issues are raised, the applicant must promptly provide corrections or clarifications. Additional documents may also be requested from the applicant.
Publication in the Official Journal
If the application is approved, the design will be published in the official gazette, giving the public a specified period to file objections.
Design Registration and Certification
If no objections are raised (or if any objections are resolved), the design will be registered, and a certificate of registration will be issued. The design is granted initial protection for 10 years.
Renewal of Registration
After 10 years, the design registration can be renewed for an additional 5 years by paying the renewal fee before the expiration date.

A registered design in India remains valid for 10 years from the date of registration. It can be renewed for an additional 5 years by paying the renewal fee before the expiry date. If the renewal fee is not paid on time, the design registration will lapse. However, the applicant can still request renewal within one year after the expiration by submitting a restoration application. Once the restoration application is approved, the applicant must pay the required fees to reinstate the design. Timely payment of renewal fees ensures continuous protection of the design. If the design is not renewed or restored, it will no longer be protected. Maintaining the design registration requires careful attention to deadlines.
