FCRA Registration Guide

Overview of FCRA Registration

The Foreign Contribution (Regulation) Act (FCRA) registration is a legal requirement in India for associations, NGOs, and other entities that wish to receive foreign donations or contributions. The primary purpose of FCRA registration is to regulate the acceptance and utilization of foreign funds to ensure they are not used for activities detrimental to the national interest. The Ministry of Home Affairs, Government of India, oversees FCRA registration, renewal, and compliance. Organisations eligible for FCRA registration include charitable trusts, societies, Section 8 companies, and other non-profit organizations engaged in social, educational, cultural, or religious activities.

    Eligibility Criteria of FCRA Registration

    • Income or assets owned by NGOs should only be used for charitable purposes.
    • The NGO should keep accurate books of accounts that include all income and outlays.
    • An organisation should not be founded to serve a specific religion, community, or caste.
    • Its primary goal should be to further charitable causes, and donations should provide for all of its funding.
    • In the event that the non-profit organisation generates revenue from its operations, the trustees of the organisation ought to uphold distinct accounting records to guarantee that donations are not misused.
    • An NGO needs to have operated for three years in order to be registered under the FCRA.
    Enhance Credibility

    Benefits of FCRA Registration

FCRA registration provides legal recognition to non-profits in India, allowing them to receive foreign contributions while complying with national laws. It enhances credibility, unlocks funding opportunities from international donors, and boosts trust among contributors. Registered organisations also enjoy tax exemptions, improving financial efficiency and sustainability, especially when local funding is limited.

    FCRA Compliance

Maintaining accurate records, submitting annual reports, properly utilizing foreign contributions, adhering to FCRA provisions, and ensuring timely renewal are essential aspects of FCRA compliance. NGOs must keep precise financial records, submit annual reports certified by a CA detailing foreign contributions, and use funds solely for intended purposes. Compliance with FCRA provisions is crucial to avoid registration cancellation, as the Ministry of Home Affairs actively monitors adherence. Additionally, if an NGO fails to secure foreign funds for two consecutive years, renewal chances diminish significantly.
